අධිකරණ ස්වාධීනත්වයට විධායක බලපෑම් හෙළාදකින යෝජනාවක් සඳහා කඩිනම් කල්තැබීමේ විවාදයක් ඉල්ලමින් විපක්ෂයේ මන්ත්රීවරුන් 35 දෙනෙකුගේ අත්සනින් යුත් ලිපියක් අද කථානායකවරයා අතට ලබාදුන්නා.

අධිකරණයට විධායකය විසින් සිදු කරනු ලබන අතපෙවීම් හෙළා දැකීමේ යෝජනාව
ශ්රී ලංකා ප්රජාතාන්ත්රික සමාජවාදී ජනරජයේ ආණ්ඩුක්රම ව්යවස්ථාව මගින් නීතියේ ආධිපත්යය සහ බලතල බෙදීමේ මූල ධර්මයෙහි පදනම ලෙස අධිකරණයේ ස්වාධීනත්වය සහතික කර ඇති බැවින්ද;
බලතල බෙදීමේ මූලර්ධමය අනුව විධායකය විසින් අධිකරණ බලය ක්රියාත්මක කිරීම සඳහා මැදිහත් නොවිය යුතු, බලපෑම් නොකළ යුතු හෝ බලපෑම් කරන බවක් පෙනෙන්නට නොතිබිය යුතු බැවින්ද;
2026 මැයි 1 වන දින පවත්වන ලද මැයි දින රැලියේදී, ජනාධිපති අනුර කුමාර දිසානායක මහතා විසින් 2026 අප්රේල් 30 වන දින විභාග වූ නඩුවකට අදාළ අධිකරණ තීන්දුව 2026 මැයි 25 වන දින ලබා දෙනු ඇති බවට ප්රසිද්ධියේ ප්රකාශ කරන ලද අතර, එම තීන්දුව ” සැමරීමට” සූදානම් වන ලෙස මහජනතාවගෙන් ඉල්ලා සිටින ලද බැවින්ද;
එවැනි ප්රකාශයන් මගින් විභාග වෙමින් පවතින අධිකරණ ක්රියාවලියක ප්රතිඵලය පිළිබඳව පූර්ව දැනුමක් හෝ අපේක්ෂාවක් පවතින බව සාධාරණ ලෙස අනුමාන කළ හැකි අතර, එමගින් විධායකයේ බලපෑමක් හෝ අතපෙවීමක් පිළිබඳ හැඟීමක් ඇති වන බැවින්ද;
යුක්තිය පසිඳලීම කෙරෙහි පවතින මහජන විශ්වාසය රඳා පවතින්නේ අධිකරණයේ සැබෑ ස්වාධීනත්වය මත පමණක් නොව, බාහිර බලපෑම් වලින් තොරව එම ස්වාධීනත්වය පවතින බව පෙනෙන්නට තිබීම මත ද වන බැවින්ද;
මෙම පාර්ලිමේන්තුව විසින් මෙසේ යෝජනා සම්මත කරනු ලබයි:
- අධිකරණයේ ස්වාධීනත්වයට හානි කරන, එයට බාධා කරන හෝ එයට බාධා කරන බව පෙනී යන විධායකයේ සාමාජිකයින්ගේ කවර වූ හෝ ප්රකාශයක් හෝ හැසිරීමක් මෙම පාර්ලිමේන්තුව ඒකමතිකව හෙළා දකී;
- ආණ්ඩුක්රම ව්යවස්ථාව, නීතියේ ආධිපත්යය සහ බලතල බෙදීමේ මූලධර්මය ආරක්ෂා කිරීම සඳහා වන සිය නොසැලෙන කැපවීම මෙම පාර්ලිමේන්තුව යළිත් තහවුරු කරයි;
- කිසියම් බලපෑමක් හෝ අනිසි ක්රියාවක් පිළිබඳ හැඟීමක් ඇතිවීම වැළැක්වීම සඳහා, විභාග වෙමින් පවතින අධිකරණ ක්රියාවලීන් සම්බන්ධයෙන් ප්රසිද්ධ ප්රකාශ සිදු කිරීමේදී විධායකය ඇතුළු සියලුම රජයේ නිලධාරීන් සංයමයෙන් යුතුව කටයුතු කළ යුතු යැයි මෙම පාර්ලිමේන්තුව ඉල්ලා සිටී;
- ජනාධිපතිතුමා විසින් සිදු කරන ලද ප්රකාශය සම්බන්ධයෙන් පැහැදිලි කිරීමක් සිදු කරන ලෙසත්, අධිකරණයේ ස්වාධීනත්වයට සහ අඛණ්ඩතාවයට ගරු කිරීම සඳහා වන සිය කැපවීම යළිත් තහවුරු කරන ලෙසත් මෙම පාර්ලිමේන්තුව ජනාධිපතිතුමාගෙන් ඉල්ලා සිටී;
- අධිකරණයේ ස්වාධීනත්වය සුරැකීමට සහ යුක්තිය පසිඳලීමේ ක්රියාවලිය කෙරෙහි මහජන විශ්වාසය ආරක්ෂා කිරීම සිය ආණ්ඩුක්රම ව්යවස්ථාපිතබලතල ප්රකාරව අවශ්ය සියලු පියවර ගැනීම පිණිස මෙම පාර්ලිමේන්තුව යෝජනා සම්මත කරයි.
Requesting an Urgent Adjournment Debate for
Resolution Condemning Executive Interference with the Judiciary
WHEREAS the Constitution of the Democratic Socialist Republic of Sri Lanka guarantees the independence of the judiciary as a foundational principle of the Rule of Law and the separation of powers;
AND WHEREAS the doctrine of separation of powers requires that the Executive shall not interfere with, influence, or appear to influence the exercise of judicial power;
AND WHEREAS at the May Day rally held on 1st May 2026, the President Anura Kumara Dissanayake publicly asserted that a court determination in a matter heard on 30th April 2026 would be delivered on 25th May 2026, and called upon the public to be prepared to “celebrate” such outcome;
AND WHEREAS such statements may reasonably be construed as implying prior knowledge of, or expectation regarding, the outcome of pending judicial proceedings, thereby giving rise to a perception of executive influence or interference;
AND WHEREAS public confidence in the administration of justice depends not only on the actual independence of the judiciary but also on the appearance of independence free from external pressure;
NOW THEREFORE BE IT RESOLVED THAT:
- This Parliament unequivocally condemns any statement or conduct by members of the Executive that undermines, interferes with, or appears to interfere with the independence of the judiciary;
- This Parliament affirms its unwavering commitment to uphold the Constitution, the Rule of Law, and the doctrine of separation of powers;
- This Parliament calls upon all public office holders, including the Executive, to exercise restraint in public statements relating to pending judicial proceedings, so as to avoid any perception of influence or impropriety;
- This Parliament urges His Excellency the President to clarify his remarks and reaffirm his commitment to respecting the independence and integrity of the judiciary;
- This Parliament resolves to take all necessary steps within its constitutional mandate to safeguard the independence of the judiciary and preserve public confidence in the administration of justice.
