අධිකරණ කොමිෂන් සභාව ස්වාධීන ආයතනයක් වන බවත් එය ඉතා වගකීම් සහගත අන්දමින් කාලාන්තරයක් මුළුල්ලේ නීතියේ ස්වාධීනත්වය ආරක්ෂා කිරීමට කටයුතු කරමින් සිටින බවත් ශ්‍රි ලංකා නීතිඥ සංගමය (BASL) විශේෂ නිවේදනයක් නිකුත් කරමින් කියා සිටි.BASL හි ප්‍රකාශය එහි සභාපති රජීව් අමරසූරිය සහ ලේකම් චතුර ගල්හේනගේ අත්සනින් යුතුව එම නිවේදනය නිකුත් කර තිබේ.
You tube වැනි සමාජ මාධ්‍යයන් ඔස්සේ, අදහස් පළ කිරීමේදී හා නීතියේ විෂයපථයට අදාළ කරුණු වාර්තා කිරීමේ දී සුපරික්ෂාකාරී අන්දමින් කටයුතු කරන ලෙසත් අසත්‍ය පුවත් වාර්තා කිරීම නීතියට පටහැනි බවත් එම නිවේදනය මඟින් නීතිඥ සංගමය පෙන්වා දෙනවා.
ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ 111(C)(1) සහ (2) වගන්ති විශේෂයෙන් සඳහන් කරමින්, නීතිය ක්‍රියාත්මක කරන බලධාරීන් ඇතුළු සියලුම පාර්ශවකරුවන්ගෙන් නීතියේ ආධිපත්‍යය ආරක්ෂා කරන ලෙස, නිසි ක්‍රියාවලිය සහතික කරන ලෙස සහ සෑම විටම පුරවැසියන්ගේ අයිතිවාසිකම් සහ නිදහස ආරක්ෂා කරන ලෙස BASL ඉල්ලා සිටියේය.
අධිකරණ සේවා කොමිෂන් සභාවේ (JSC) සහ අධිකරණයේ විෂය පථයට අයත් කරුණු සම්බන්ධයෙන් සමාජ මාධ්‍ය සහ වෙනත් වේදිකාවල සංසරණය වන අදහස් සහ අන්තර්ගතයන් රාශියකට ප්‍රතිචාර වශයෙන් මෙම ප්‍රකාශය නිකුත් කර තිබේ.
අගවිනිසුරුවරයා සහ ශ්‍රේෂ්ඨාධිකරණයේ ජ්‍යෙෂ්ඨ විනිසුරුවරුන් දෙදෙනෙකුගෙන් සමන්විත අධිකරණ සේවා කොමිසම, මහාධිකරණ විනිසුරුවරුන් මාරු කිරීම මෙන්ම අධිකරණ නිලධාරීන් සහ නිශ්චිත රාජ්‍ය නිලධාරීන් පත් කිරීම, උසස් කිරීම, මාරු කිරීම, විනය පාලනය සහ සේවයෙන් පහ කිරීම සම්බන්ධයෙන් බලය ඇති ස්වාධීන ආයතනයක් ලෙස ක්‍රියා කරන බවද නීතිඥ සංගමය පෙන්වා දෙනවා.
සමාජ මාධ්‍ය සටහන්, ප්‍රසිද්ධ ප්‍රකාශ, සමපේක්ෂණ විවරණ හෝ නඩු ප්‍රතිඵල පිළිබඳ You tube කරුවන්ගේ අනාවැකි හරහා අධිකරණයට ඇඟිලි ගැසීමට උත්සාහ කිරීම බරපතල තර්ජන එල්ල කරන බවට BASL අනතුරු අගවා සිටි.
එවැනි ක්‍රියා, නීතියේ ආධිපත්‍යය අඩපණ කිරීම, නිසි ක්‍රියාවලියට හානි කිරීම සහ යුක්තිය පසිඳලීම පිළිබඳ මහජන විශ්වාසය බිඳ දැමීමේ අවදානමක් ඇති බවත් එවැනි ක්‍රියාවන්හි වැරදිකරුවන්ට ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ විධිවිධාන යටතේ නීතිමය ප්‍රතිවිපාකවලට මුහුණ දිය හැකි බව BASL සිය නිවේදනය මගින් පෙන්වා දෙනවා.

STATEMENT OF THE BAR ASSOCIATION OF SRI LANKA PERTAINING TO COMMENTS SEEN ON SOCIAL MEDIA AND OTHER PLATFORMS ON MATTERS THAT COME WITHIN THE PURVIEW OF THE JUDICIAL SERVICE COMMISSION AND THE JUDICIARY
In the past week, there have been comments made on social media and other platforms pertaining to matters that come within the purview of the Judicial Service Commission and the Judiciary, which are both Independent Institutions.
The Judicial Service Commission is a Commission consisting of the Chief Justice and two Senior Judges of the Supreme Court, which holds responsibility in relation to the transfer of judges of the High Court, as well as for the appointment, promotion, transfer, disciplinary control and dismissal of judicial officers and relevant scheduled public officers.
The BASL has continuously stood for the independence of the judiciary, which must be safeguarded and protected from any form of outside threat or interference, sought to be affected through social media posts, statements, commentaries or purported predictions by YouTubers on case outcomes. Such acts undermine the rule of law, threatens the due process of law and can have potential to impact the public confidence in the administration of justice.
Perpetrators of such acts can be dealt with in terms of the Law. In this respect, attention is invited to Article 111(C)(1) and (2) of the Constitution which contain penal provisions regarding interference with the judiciary.
In conjunction to the forgoing, the BASL emphasizes the need for all stakeholders including law enforcement authorities to safeguard the Rule of Law, due process and the protection of the rights and liberties of citizens at all times.
